Article 1 – Definitions

For the purposes of these Terms & Conditions, the following definitions apply:

Cooling-off Period: The period during which the consumer may exercise their right of withdrawal.

Consumer: Any natural person acting for purposes outside their trade, business, craft, or profession who enters into a distance contract with the trader.

Day: A calendar day.

Continuous Performance Contract: A distance contract relating to a series of products and/or services, where the delivery and/or purchase obligations are spread over a period of time.

Durable Medium: Any instrument that enables the consumer or the trader to store information addressed personally to them in a manner that allows future consultation and unchanged reproduction of the stored information.

Right of Withdrawal: The consumer's right to cancel a distance contract within the applicable cooling-off period.

Trader: The natural or legal person offering products and/or services to consumers by means of distance selling.

Distance Contract: A contract concluded between the trader and the consumer under an organised distance sales system, where exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.

Means of Distance Communication: Any method that allows a contract to be concluded without the consumer and the trader being physically present together at the same time.

Terms & Conditions: These Terms & Conditions of the trader.

Article 3 – Applicability

These Terms & Conditions apply to every offer made by the trader and to every distance contract and order concluded between the trader and the consumer.

Before a distance contract is concluded, these Terms & Conditions shall be made available to the consumer. If this is not reasonably possible, the consumer will be informed, prior to the conclusion of the contract, where the Terms & Conditions may be consulted and that they will be provided free of charge upon request.

Where the distance contract is concluded electronically, these Terms & Conditions may, notwithstanding the previous paragraph, be made available electronically in such a way that the consumer can easily store them on a durable medium.

If specific product or service terms apply in addition to these Terms & Conditions, the above provisions shall apply accordingly. In the event of conflicting provisions, the consumer may rely upon the provision that is most favourable to them.

Should any provision of these Terms & Conditions be held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with one that most closely reflects the purpose and intent of the original provision.

Any matters not expressly covered by these Terms & Conditions, or any ambiguity concerning their interpretation, shall be assessed in accordance with the spirit and purpose of these Terms & Conditions.


Article 4 – The Offer

Where an offer is subject to a limited period of validity or specific conditions, this shall be clearly stated.

All offers made by Olivia Mayfair are non-binding. Olivia Mayfair reserves the right to amend or withdraw any offer at any time.

The offer shall contain a complete and accurate description of the products and/or services offered, enabling the consumer to make a proper assessment. Product images are intended to provide a true representation of the products. However, obvious errors or mistakes shall not be binding upon the trader.

All images, specifications, and product information are provided for illustrative purposes only and may not give rise to any claim for compensation or termination of the agreement. Olivia Mayfair cannot guarantee that colours displayed on your device will exactly match the actual colours of the products.

The offer shall clearly state the rights and obligations associated with its acceptance, including but not limited to:

  • the purchase price, excluding import duties, customs clearance fees, and import VAT (where applicable, these charges shall be payable by the recipient);
  • any shipping costs;
  • the manner in which the contract is concluded and the steps required to do so;
  • whether the statutory right of withdrawal applies;
  • the available methods of payment, delivery, and fulfilment;
  • the period during which the offer remains valid or the price is guaranteed;
  • any charges applicable to distance communication where these differ from the standard communication rate;
  • whether the contract will be archived and, if so, how the consumer may access it;
  • the manner in which the consumer may review and correct the information provided before concluding the contract;
  • any languages in which the contract may be concluded in addition to English;
  • any codes of conduct to which Olivia Mayfair subscribes and how these may be consulted electronically;
  • the minimum duration of any continuous performance contract;
  • where applicable, the available sizes, colours, and materials.

Article 5 – Formation of the Agreement

The agreement is concluded when the consumer accepts the offer and fulfils the conditions attached to it.

Where the consumer has accepted the offer electronically, Olivia Mayfair shall confirm receipt of the acceptance electronically without undue delay. Until such confirmation has been received, the consumer may cancel the agreement.

For electronically concluded agreements, Olivia Mayfair shall implement appropriate technical and organisational measures to secure the electronic transfer of data and maintain a secure online environment. Where electronic payment methods are used, suitable security measures shall be applied.

Within the limits of applicable law, Olivia Mayfair reserves the right to assess whether the consumer is able to fulfil their payment obligations and to consider all relevant facts necessary for responsibly entering into the agreement. If reasonable grounds exist, Olivia Mayfair may refuse an order or impose special conditions on its execution.

Olivia Mayfair shall provide the consumer, either in writing or on another durable medium, with the following information:

  • the business address where complaints may be submitted;
  • the conditions and procedure for exercising the right of withdrawal, or a clear statement where this right does not apply;
  • information regarding warranties and after-sales services;
  • the information referred to in Article 4, where not already provided before the agreement was concluded;
  • the conditions for terminating the agreement where it has a duration exceeding one year or is of indefinite duration.

In the case of a continuous performance contract, the above obligation applies only to the first delivery.

Every agreement is concluded subject to the availability of the relevant products.

Article 6 – Right of Withdrawal

When purchasing products, the consumer has the right to withdraw from the agreement within 30 days without providing any reason. The withdrawal period begins on the day after the consumer, or a representative designated by the consumer, has received the goods.

During the cooling-off period, the consumer must handle the product and its packaging with reasonable care. The product may only be unpacked or used to the extent necessary to establish its nature, characteristics, and functionality. If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and, where reasonably possible, in its original condition and packaging, in accordance with the reasonable instructions provided by Olivia Mayfair.

The consumer must notify Olivia Mayfair in writing (by email) within 30 days of receiving the goods that they wish to exercise their right of withdrawal. The product must then be returned within 14 days of this notification. The consumer is responsible for providing proof that the goods were returned on time, for example by supplying proof of postage.

If the consumer fails to notify Olivia Mayfair within the withdrawal period or does not return the goods within the required timeframe, the purchase shall become final.


Article 7 – Costs in the Event of Withdrawal

If the consumer exercises the right of withdrawal, the cost of returning the goods shall be borne by the consumer.

Any payments already made by the consumer shall be refunded by Olivia Mayfair as soon as reasonably possible and no later than 14 days after the withdrawal, provided that the returned goods have been received or the consumer has supplied satisfactory proof that the goods have been returned in full.


Article 8 – Exclusion of the Right of Withdrawal

Olivia Mayfair may exclude the right of withdrawal for certain products and services listed below, provided this has been clearly stated in the offer before the agreement is concluded.

The right of withdrawal may be excluded for products:

  • manufactured according to the consumer's specifications;
  • clearly personalised or made to order;
  • which, by their nature, cannot be returned;
  • which are liable to deteriorate or expire rapidly;
  • whose price is subject to fluctuations in the financial market beyond the control of Olivia Mayfair;
  • newspapers, magazines, or periodicals supplied individually;
  • sealed audio or video recordings and computer software where the seal has been broken after delivery;
  • sealed hygiene products where the seal has been broken after delivery.

The right of withdrawal may also be excluded for services relating to:

  • accommodation, transport, catering, or leisure activities to be provided on a specific date or during a specified period;
  • services that have commenced with the consumer's explicit consent before the cooling-off period has expired;
  • betting and lottery services.

Article 9 – Prices

During the validity period stated in the offer, the prices of the products and/or services offered shall not be increased, except where changes result from alterations to VAT rates or other applicable taxes.

Notwithstanding the above, Olivia Mayfair may offer products or services with variable prices where these are subject to fluctuations in financial markets beyond its control. In such cases, it shall be clearly stated that the prices shown are indicative only.

Price increases within three months of the conclusion of the agreement shall only be permitted where they result directly from statutory regulations or legal provisions.

Price increases taking effect more than three months after the agreement has been concluded shall only be permitted where this has been expressly agreed and:

  • they result from statutory regulations or legal provisions; or
  • the consumer has the right to terminate the agreement from the date on which the price increase takes effect.

Deliveries are dispatched from outside the United Kingdom. As a result, import duties, customs charges, import VAT, or other applicable taxes may be charged by UK Customs or the delivery carrier before or upon delivery. These charges are the sole responsibility of the customer and are not included in the purchase price unless expressly stated otherwise.

All prices are subject to typographical and printing errors. Olivia Mayfair accepts no liability for the consequences of such errors and shall not be obliged to supply products at an incorrectly displayed price.


Article 10 – Conformity and Warranty

Olivia Mayfair warrants that its products and/or services conform to the agreement, the specifications stated in the offer, reasonable standards of quality and fitness for purpose, and all applicable legal requirements in force at the time the agreement is concluded. Where expressly agreed, Olivia Mayfair also warrants that a product is suitable for purposes other than its normal intended use.

Any warranty provided by Olivia Mayfair, the manufacturer, or the importer shall not affect the consumer's statutory rights.

Any defects or incorrectly supplied products must be reported in writing within 14 days of delivery. Returned products must be sent back in their original packaging and in unused condition.

The warranty period provided by Olivia Mayfair corresponds to the manufacturer's warranty period where applicable. However, Olivia Mayfair is never responsible for determining whether a product is suitable for a consumer's specific intended use, nor for providing advice regarding the use or application of any product.

The warranty shall become void if:

  • the consumer has repaired, modified, or altered the product themselves, or has had this carried out by a third party;
  • the product has been exposed to abnormal conditions, mishandled, or used contrary to the provided instructions;
  • the defect results wholly or partly from government regulations concerning the nature or quality of the materials used.

Article 11 – Delivery and Performance

Olivia Mayfair shall exercise the greatest possible care in receiving and processing customer orders.

The place of delivery shall be the address provided by the consumer at the time of placing the order.

Orders shall be processed as quickly as reasonably possible and, unless otherwise agreed, no later than 30 days after the order has been placed. If delivery is delayed, or if an order cannot be fulfilled in whole or in part, the consumer shall be informed no later than 30 days after placing the order. In such cases, the consumer has the right to cancel the agreement free of charge and shall be entitled to a full refund within 14 days.

If an ordered product is unavailable, Olivia Mayfair may endeavour to supply a suitable replacement product. The consumer shall be informed clearly if a replacement item is supplied. Where a replacement product is returned, the return shipping costs shall be borne by Olivia Mayfair.

The risk of loss of or damage to products shall remain with Olivia Mayfair until the goods have been delivered to the consumer or to a representative designated by the consumer, unless otherwise expressly agreed.
